Digital Millennium Copyright Act Notice

NeuraQuiz respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using our website.

1. Copyright Policy

It is NeuraQuiz's policy to:

  • Respond to notices of alleged copyright infringement that comply with the DMCA
  • Promptly remove or disable access to material claimed to be infringing
  • Terminate, in appropriate circumstances, the accounts of repeat infringers

2. Filing a DMCA Notice of Copyright Infringement

If you believe that content on our website infringes your copyright, please provide our Copyright Agent with a written notice (a "DMCA Notice") containing the following information:

A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works.

B. Identification of the Infringing Material

A description of where the material that you claim is infringing is located on our website. Please provide sufficient detail to allow us to locate the material (such as specific URLs or page identifiers).

C. Your Contact Information

Your name, address, telephone number, and email address. We must be able to contact you regarding your complaint.

D. Good Faith Statement

A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

E. Accuracy Statement

A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

F. Physical or Electronic Signature

An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

3. How to Submit a DMCA Notice

Please note: Only DMCA notices should be sent to the Copyright Agent. Any other feedback, comments, requests for technical support, or other communications should be directed to our general contact channels.

4. What Happens After We Receive Your DMCA Notice

Upon receipt of a valid DMCA Notice, we will:

  1. Promptly investigate the complaint
  2. Remove or disable access to the allegedly infringing material
  3. Notify the user who posted the content that it has been removed or disabled
  4. Provide the user with a copy of your DMCA Notice
  5. Advise the user of their right to file a counter-notification

5. Counter-Notification Procedure

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with us. A counter-notification must include:

1. Your physical or electronic signature

2. Identification of the material that has been removed or disabled and the location where it appeared before removal

3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification

4. Your name, address, and telephone number

5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which NeuraQuiz may be found

6. A statement that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person

Send your counter-notification to the same Copyright Agent address listed above with the subject line: "DMCA Counter-Notification"

6. What Happens After a Counter-Notification

Upon receipt of a valid counter-notification, we will:

  1. Promptly provide the original complaining party with a copy of the counter-notification
  2. Inform them that we will replace the removed material or cease disabling access to it in 10-14 business days
  3. Replace the removed material or cease disabling access to it in 10-14 business days following receipt of the counter-notification, unless our Copyright Agent first receives notice that the complaining party has filed an action seeking a court order to restrain the user from engaging in infringing activity

7. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, NeuraQuiz has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to our website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

8. Misrepresentations

Important Warning:

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing or was removed or disabled by mistake or misidentification may be subject to liability. Please ensure that your DMCA Notice or Counter-Notification is accurate and made in good faith.

9. Fair Use Consideration

Before submitting a DMCA Notice, please consider whether the use of the copyrighted material at issue may be protected under the "fair use" doctrine. Fair use is a legal doctrine that permits limited use of copyrighted material without acquiring permission from the rights holders.

Fair use factors include:

  • The purpose and character of the use (educational, transformative, commercial, etc.)
  • The nature of the copyrighted work
  • The amount and substantiality of the portion used
  • The effect of the use upon the potential market for the copyrighted work

12. Processing Time

We strive to process all DMCA Notices and Counter-Notifications as quickly as possible. Typically:

  • Valid DMCA Notices are processed within 24-72 hours
  • Content removal occurs within 48 hours of validation
  • Counter-Notifications are forwarded to the complaining party within 48 hours
  • Content restoration (if applicable) occurs 10-14 business days after counter-notification

13. Limitation of Liability

NeuraQuiz acts as an intermediary in the DMCA process. We do not make determinations about the validity of copyright claims or the application of fair use. Our role is limited to processing notices in accordance with the DMCA. We are not liable for any claims arising from the removal or restoration of content pursuant to the DMCA.

14. Changes to This Policy

We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website after changes constitutes acceptance of the modified policy.
